Agreement to Terms. These Terms & Conditions (the “Terms”) are a binding agreement between you and Everyday Sage, owned and operated by Jennifer Scavina. By accessing or using www.everydaysage.com (the “Site”), you agree to these Terms and our Privacy Policy.

Who may use the Site. You must be at least 13 years old to use the Site. If you use the Site on behalf of an entity, you represent that you are authorized to bind that entity to these Terms.

1) Changes to the Site or Terms

We may update the Site and these Terms from time to time. If changes are material, we will post the updated Terms with a new “Last updated” date. Continued use of the Site after the changes take effect constitutes acceptance.

2) Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use information.

3) Content and intellectual property

Ownership. The Site, including text, graphics, logos, and other materials, is owned by Everyday Sage or its licensors and is protected by copyright, trademark, and other laws.

Limited license. We grant you a limited, non‑exclusive, non‑transferable license to access and use the Site for personal, non‑commercial purposes.

Restrictions. You may not copy, modify, distribute, publicly display, scrape, reverse engineer, or create derivative works from the Site or its content unless we give you written permission or a specific license.

Trademarks. “Everyday Sage” and related marks are our trademarks or service marks. You may not use them without our prior written consent.

4) User content

If the Site allows you to submit or upload content (e.g., comments or messages):

You retain ownership of your content but grant us a non‑exclusive, worldwide, royalty‑free license to host, store, and display it for the purpose of operating the Site.

You represent that you have the rights necessary for the content you submit and that it does not infringe others’ rights or violate the law.

We may remove content that violates these Terms.

5) Acceptable use

You agree not to misuse the Site, including by:

Interfering with or disrupting the Site; introducing malware; circumventing security; or attempting to access non‑public features.

Using the Site to violate any law or to infringe on anyone’s intellectual property, privacy, or other rights.

Automated access (e.g., bots, scrapers) except for standard indexing by search engines or with our written permission.

6) Third‑party services and links

The Site may link to or integrate with third‑party services (including our hosting platform, Squarespace). We are not responsible for their content or policies.

7) Reporting IP concerns

We respect intellectual‑property rights and respond to notices of alleged infringement. If you believe content on the Site infringes your rights, email info@everydaysage.com with: (a) your contact info; (b) a description and location (URL) of the material; (c) a statement that you have a good‑faith belief the use is not authorized; and (d) a statement, under penalty of perjury, that your notice is accurate and you are authorized to act. We may remove or disable access to the material and, where feasible, notify the content provider.

8) Disclaimers

The Site is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Site will be uninterrupted, secure, or error‑free, or that content is accurate or complete.

9) Limitation of liability

To the fullest extent permitted by law, Everyday Sage and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the Site. Our aggregate liability for any claim will not exceed US $100.

10) Indemnification

You agree to indemnify and hold harmless Everyday Sage and its owners, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or violation of these Terms.

11) Governing law; venue

These Terms are governed by the laws of the State of California, without regard to conflict‑of‑law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Los Angeles County, California for any dispute not subject to arbitration.

12) Dispute resolution; arbitration

Before filing a claim, you agree to try to resolve the dispute informally by emailing info@everydaysage.com. If we cannot resolve it within 30 days, either party may bring an individual claim in small‑claims court or submit the dispute to binding arbitration on an individual basis under the Consumer Arbitration Rules of the American Arbitration Association. No class actions or class arbitration. This section does not limit either party’s right to seek injunctive relief for misuse of intellectual property.

13) Termination

We may suspend or terminate access to the Site at any time for any reason. Sections that by their nature should survive termination (e.g., IP, disclaimers, limitations of liability) will survive.

14) Miscellaneous

If a term is unenforceable, the rest remain in effect. These Terms are the entire agreement between you and us regarding the Site. We may assign these Terms; you may not assign them without our consent.

Accessibility Clause

We are committed to digital accessibility and strive to conform to WCAG 2.1 AA. Accessibility work is ongoing. We will make reasonable efforts to provide the content you need.

Copyright Notice

All content on the Site is protected by copyright and other laws. Everyday Sage and its licensors reserve all rights not expressly granted. A year‑specific copyright notice is not required for protection.
